Site & Sales Terms

1. All Purchasers’ orders are hereby accepted in accordance with the terms and conditions set forth below, unless otherwise noted in writing by Purchaser within 24 hours hereof. All orders subject to final written acceptance by Calvary Supply Company. Unless defective, all sales are final. Calvary Supply Company does not offer refunds or exchanges unless items are defective during the first 15 days. After 15 days the warranty covered by the manufacturer will apply.

2. Orders must be accompanied by an advance payment as determined by Calvary Supply Company. Orders presented by faxed check will be considered as actual documents and accepted for electronic transfer of funds, in accordance with accepted laws.

3. Unless otherwise stated, all prices are F.O.B. shipping point. Calvary Supply Company reserves the right to select means of shipment, consistent with lowest cost and best service. Federal, state, or local taxes of any sort, now and hereafter imposed on the sale of products herein, shall be paid by Purchaser.

4. Following acceptance by Calvary Supply Company and Little Giant, orders are not subject to cancellation or modification, except upon written approval of Calvary Supply Company and may be subject to cancellation charges as determined by Calvary Supply Company and Little Giant.

5. Calvary Supply Company and Little Giant shall not be responsible for delays in shipment or non-fulfillment of this order due to accidents, fire, strikes, material shortages, acts of God, or other causes beyond the control of Calvary Supply Company or Little Giant.

6. The materials listed were produced in accordance with the Fair Labor Standards Act of 1938 as amended.

7. Calvary Supply Company and Little Giant warrants to Purchaser that its products shall be free of defect in workmanship or materials, however Calvary Supply Company and Little Giant’s sole obligation under this warranty shall consist of repairing or replacing, free of charge, F.O.B. factory, any parts returned prepaid at its factory (with a return authorization) within one year from the delivery date of parts to Purchaser and determined by Calvary Supply Company and Little Giant upon inspection to be defective. No product shall be returned without the expressed written approval of Calvary Supply Company and Little Giant. NO OTHER WARRANTY, EXPRESSED OR IMPLIED, AS TO DESCRIPTION, QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ANY OTHER MATTER IS GIVEN BY CALVARY SUPPLY COMPANY OR LITTLE GIANT IN CONNECTION HEREWITH. THE SELECTION, APPLICATION, SUITABILITY FOR CORROSION RESISTANCE OR USE FOR ANY PURPOSE, ARE PURCHASER’S SOLE RESPONSIBILITY. UNDER NO CIRCUMSTANCES SHALL CALVARY SUPPLY COMPANY AND LITTLE GIANT BE LIABLE FOR LOSS OF PROFITS OR ANY OTHER DIRECT OR INDIRECT COSTS, EXPENSES, LOSSES OR DAMAGES ARISING OUT OF DEFECTS IN OR FAILURE OF THE PRODUCT OR ANY PART THEREOF.

8. Little Giant’s products are designed and built to be compatible with a high level of safety and health standards, commensurate with pricing. It is Calvary Supply Company and Little Giant’s expectation that the products installed, operated, and maintained properly will enable Purchaser to comply with the regulation and interpretations of federal, state, or local governmental authority, or industry health and safety standards. Calvary Supply Company and Little Giant however, make no representation or warranty that its equipment meets all or the requirements of said standards because of the present vagueness in the requirements and varied interpretations thereof. Products can only be shipped on this understanding. It shall be Purchaser’s responsibility to determine that all safety devices and controls are in the proper location and in operating order at all times, and to instruct the operating personnel in their use and operation and to maintain all safety devices, controls, and products after delivery. All devices and accessories shall be installed by licensed professionals.

9. Where Purchaser has delivered to Little Giant or Calvary Supply Company parts, equipment, material, jigs, fixtures, wiring, or any other item for use by Little Giant in manufacturing, processing, assembling, or modification of products for Purchaser, the Purchaser’s property shall be considered personal property and title and the right to possession shall vest in Little Giant until all payments hereunder (including deferred payments, whether evidenced by notes or otherwise) shall have been paid in full and in cash. Calvary Supply Company and Little Giant shall not be liable for loss or damage to Purchaser’s property in its possession. Purchaser agrees to perform all acts necessary to perfect and maintain such right and title in Calvary Supply Company and Little Giant.
